Welcome to TowMigo ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our towing and roadside assistance services ("Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

2. Service Overview

TowMigo provides professional 24/7 towing and roadside assistance services including but not limited to:

  • Vehicle towing and recovery services
  • Emergency roadside assistance (jump starts, tire changes, lockout services)
  • Fuel delivery services
  • Electric vehicle charging support
  • Winching and recovery services

3. Payment and Refund Policy

3.1 Payment Terms

  • All services require payment upon completion unless prior arrangements have been made
  • We accept all major credit/debit cards, digital payment methods including PhonePe, and other authorized payment methods
  • Prices are subject to change without notice based on service requirements
  • Additional charges may apply for special circumstances (after hours, hazardous conditions, etc.)

3.2 Refund Policy

Due to the immediate and perishable nature of our services, TowMigo does not offer refunds once services have been rendered. This includes but is not limited to:

  • Services already performed at your request
  • Dispatch fees once a service vehicle has been sent to your location
  • Time-based charges for waiting time at your request

3.3 Website and Payment Management

This website and all payment processing are managed and operated by TowMigo. Payments are securely processed through authorized payment gateways including PhonePe, and all charges will appear under the name TowMigo or its registered payment partners.

4. User Responsibilities

As a user of our Services, you agree to:

  • Provide accurate vehicle information (make, model, year, license plate)
  • Ensure the service location is safe and accessible
  • Have proper ownership or authorization for the vehicle being serviced
  • Remove personal belongings before towing
  • Pay for all services rendered
  • Provide true, accurate and complete information during registration and use of Services

5. Intellectual Property Rights

The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents includes and is not limited to the design, layout, look and graphics.

You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws.

6. Limitations of Liability

TowMigo shall not be liable for:

  • Pre-existing damage to your vehicle
  • Damage caused by improper vehicle preparation
  • Consequential damages from service delays
  • Loss of personal items left in the vehicle
  • Acts of nature or circumstances beyond our control

Our maximum liability for any service claim is limited to the amount paid for that specific service.

In no event will the Platform Owner be liable for any indirect, consequential, incidental, special or punitive damages, including without limitation damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data or loss of other economic interests, whether in contract, negligence, tort or otherwise, arising from the use of or inability to use the Services, however caused and whether arising in contract, tort, negligence, warranty or otherwise, exceed the amount paid by You for using the Services giving rise to the cause of action or Rupees One Hundred (Rs. 100) whichever is less.

7. Service Limitations

Our services may be subject to:

  • Geographical restrictions based on your location
  • Vehicle type and weight limitations
  • Road and weather conditions
  • Equipment availability

We reserve the right to refuse service at our discretion, particularly in unsafe conditions.

9. Indemnification

You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

10. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.

11. Modifications

We may modify these Terms at any time. The updated version will be posted on our website with a new "Last Updated" date. Your continued use of our Services constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in noida.

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Noida.

13. Vendor Terms and Conditions

13.1 Vendor Partnership Agreement

By becoming an authorized TowMigo vendor, you agree to the following terms:

  • Service Standards: Vendors must maintain all required licenses, insurance, and equipment to perform services
  • Response Time: Vendors must respond to dispatch requests within 30 minutes during operational hours
  • Pricing: Vendors agree to TowMigo's standardized pricing structure for all services
  • Payment Terms: Vendor payments will be processed within 7-10 business days after service completion
  • Quality Assurance: Vendors must participate in TowMigo's quality control program

13.2 Vendor Responsibilities

  • Maintain all necessary business licenses and permits
  • Carry adequate liability insurance (minimum ₹20 lakh coverage)
  • Ensure all equipment meets safety standards
  • Provide professional, courteous service to all customers
  • Report all service completions within 1 hour via TowMigo portal

13.3 Vendor Compensation

  • Payment rates are determined by service type and location
  • Additional compensation may apply for special circumstances
  • Disputes must be submitted within 72 hours of service completion
  • Recurring violations may result in partnership termination

13.4 Termination of Agreement

Either party may terminate this agreement with 30 days written notice. TowMigo reserves the right to immediately terminate vendors for:

  • Violation of safety protocols
  • Repeated customer complaints
  • Fraudulent activity
  • Failure to maintain required insurance/licensing
